This policy explains how Luken Solar (Pty) Ltd (“we”, “us”, “our”) collects, uses, shares, and protects personal information. We operate in South Africa and follow the Protection of Personal Information Act, 2013 (POPIA).

2) The information we collect
- Identity & contact: name, job title, company, email, phone, address.
- Project information: site location, energy usage estimates, photos and documents you share, meeting notes.
- Account & support: emails, messages, call notes, service requests.
- Marketing & analytics: page views, device/browser data, referral source, campaign tags (e.g., UTM).
- Billing (where relevant): invoices, VAT number, payment confirmations (payments handled by our providers).
- Recruitment (where relevant): CV, portfolio, references.
We do not intentionally collect special personal information (e.g., health, religion) or data about children.
3) How we collect it
- Direct from you: forms on our site, emails, calls, meetings, events.
- Automatic: cookies and similar tech when you use our website (see Cookies below).
- Third parties (business context): partners, service providers, and public sources (e.g., business directories), with due care.
4) Why we use your information (lawful purposes)
- Provide services: site assessments, ROI Snapshots, proposals, installation and after-sales support.
- Communications: answer queries, book calls, send updates you request.
- Marketing (opt-in/legitimate interests): newsletters, case studies, event invites; you can opt out anytime.
- Security & operations: protect our platforms, prevent fraud, improve our services.
- Legal & compliance: contracts, tax records, responding to POPIA requests, handling disputes.
We only process data that is necessary and relevant. Where we rely on consent, you can withdraw it at any time.
5) Sharing your information
We share personal information only when needed:
- Operators/service providers: hosting, email, CRM, analytics, communications, file storage, project tools (bound by contracts and confidentiality).
- Professional advisers: legal, accounting, compliance.
- Regulators/authorities: where required by law.
- Business transfers: if we restructure or sell part of the business.
We do not sell personal information.
6) Cross-border transfers
Some trusted providers may process data outside South Africa. We use providers that offer adequate protection and we put agreements in place to meet POPIA requirements. You can ask us which providers we use.
7) Retention
We keep personal information only as long as needed for the stated purposes and to meet legal or tax duties. Typical retention is up to 5 years after a project or last contact, unless the law requires longer. We then delete or anonymise the data.
8) Your rights (POPIA)
You may:
- Access your personal information.
- Correct incomplete or inaccurate data.
- Delete data (where allowed).
- Object to certain processing (including direct marketing).
- Withdraw consent where processing is based on consent.
- Complain to the Information Regulator (South Africa).

9) Security
We use reasonable technical and organisational safeguards, including access controls, staff training, encrypted storage where appropriate, and regular reviews. No security is perfect; if a material breach occurs, we will act swiftly and notify where required.
10) Cookies
We use cookies and similar technologies to run the site and understand usage.
- Strictly necessary: security, load-balancing, core functions.
- Analytics: understanding visits and page performance (e.g., Google Analytics 4).

Our services are for business clients. We do not knowingly collect data about children. If you believe a child has provided data, contact us and we will act.
